NOTICE OF DETERMINATION FOR
FEDERAL-STATE EXTENDED DURATION BENEFITS (FED-ED EXTENSION)

Federal and California State laws allow California to pay FED-ED benefits under the provisions of the Federal-State Extended Unemployment Compensation Act of 1970 (26 United States Code [U.S.C.], Section 3304(a)(11) note [Public Law {Pub.L.} No. 91-373] [August 10, 1970]). The U.S. Department of Labor has instructed California that the first date a FED-ED extension can begin is May 10, 2020. Once filed, benefits are potentially payable until you collect all available FED-ED benefits, you are eligible for a new regular Unemployment Insurance claim, or until California’s unemployment rate is no longer at the level required by Federal and State laws for paying FED-ED benefits, whichever of these occurs first.

NOTICE

Under 18 U.S.C. Section§1001, knowingly and willfully concealing a material fact by any trick, scheme, or device or knowingly making a false statement in connection with this claim is a Federal Offense, punishable by a fine of not more than $10,000 or imprisonment for not more than five years, or both.

APPEAL RIGHTS

Any appeal from this notice must be filed on or before MM/DD/YYYY to be timely.

This decision is final unless appealed to an Administrative Law Judge of the California Unemployment Insurance Appeals Board (CUIAB) within 30-days from the date this notice was handed or mailed to you. You may appeal this determination by completing the enclosed appeal form or by writing a letter. Appeal forms are also available on the EDD website at edd.ca.gov/pdf_pub_ctr/de1000m.pdf In your appeal you must state the reasons why you do not agree with this decision. Appeals should be sent to the office on this Notice of Determination.

While an appeal is pending you must continue to submit a weekly claim for each week that you contend you are eligible. If the final decision by the California Unemployment Insurance Appeals Board (CUIAB) finds you eligible, you can be paid only for those weeks you filed a weekly claim and met all other eligibility requirements.
