NOTICE OF DETERMINATION FOR FEDERAL-STATE EXTENDED DURATION BENEFITS (FED-ED EXTENSION)

Federal and California State laws allow California to pay FED-ED benefits under the provisions of the Federal-State Extended Unemployment Compensation) Act of 1970 (26 United States Code [U.S.C.], Section 3304[a][11] note). The first date a FED-ED extension can begin is May 10, 2020. Once filed, benefits are potentially payable until you collect all available FED-ED benefits, you are eligible for a new regular Unemployment Insurance claim, or until California’s unemployment rate is no longer at the level required by Federal and State laws for paying FED-ED benefits, whichever of these occurs first.

ADDITIONAL ELIGIBILITY REQUIREMENTS FOR FED-ED CLAIMANTS

Due to the unique situation and lack of available work created by the COVID-19 health crisis, you are not required to look for work at this time. However, if at a later date you are required to look for work, you will be notified by mail.
In order to receive FED-ED benefits, you must continue to meet all UI eligibility criteria. You must also meet the following FED-ED benefit eligibility provisions.
  1. You must accept offers of "suitable" work. Your FED-ED benefits may be denied if you fail to accept offers of suitable work or fail to apply for suitable work when referred by California’s Workforce Services (CUIC § 4553). If you do not have a date to return to work within 30 days of filing your FED-ED extension, your prospects for obtaining work in your usual occupation are not considered to be good. Therefore, any work that you are capable of performing is considered "suitable" work.

If you are disqualified on your FED-ED extension under the job refusal provisions in CUIC § 4553, you will be ineligible to receive FED-ED benefits for the week you refused work and will remain ineligible until you have (CUIC § 4555[a] [b]):
  1. Performed work in at least 4 separate weeks after the week your disqualification began, AND
  2. Earned at least 4 times your weekly benefit amount.
  1. If you were previously disqualified on your regular claim or other federal extension claim for refusing work under CUIC § 1257[b], the disqualification will be reinstated on your FED-ED extension until you meet the following requirements (CUIC § 4552 [d]):
    1. Satisfied the 2-10 week /period of disqualification (as required by CUIC § 1260[b]), AND
    2. Performed at least 1 week of full-time work after the week your disqualification began, OR
    3. Earned at least 1 times your weekly benefit amount.
  2. If you were previously disqualified on your regular claim or other federal extension claim for separating from your job due to the irresistible compulsion to consume intoxicants under CUIC § 1256.4, the disqualification will be reinstated on your FED-ED extension until you meet the following requirements (CUIC § 4552[f]):
    1. Performed work after the week your disqualification began, AND
    2. Earned at least 5 times your weekly benefit amount.

NOTICE

Under 18 U.S.C. §1001, knowingly and willfully concealing a material fact by any trick, scheme, or device or knowingly making a false statement in connection with this claim is a Federal Offense, punishable by a fine of not more than $10,000 or imprisonment for not more than five years, or both.

APPEAL RIGHTS

This decision is final unless appealed to an Administrative Law Judge (ALJ) of the California Unemployment Insurance Appeals Board (CUIAB) within 30-days from the date this notice was handed or mailed to you. You may appeal this determination by completing the enclosed appeal form or by writing a letter. Appeal forms are also available on our website at edd.ca.gov/pdf_pub_ctr/de1000m.pdf In your appeal you must state the reasons why you do not agree with this decision. Appeals should be sent to the office on this Notice of Determination. While an appeal is pending you must continue to submit a weekly claim for each week that you contend you are eligible. If the final decision by the California Unemployment Insurance Appeals Board (CUIAB) finds you eligible, you can be paid only for those weeks you filed a weekly claim and met all other eligibility requirements.
