Sec. 233 (19 USC 2293, 20 CFR 617.15 and 617.19)
- The benefit period for a basic TRA claim is the 104-week period beginning with the Sunday after the most recent qualifying separation from adversely affected employment.
- The maximum amount payable on a TRA basic claim is equal to 52 times the WBA of the Controlling UI Claim* minus the maximum benefit amount (MBA) of the Controlling UI Claim*. This remainder is further reduced by the benefits paid on federal or state-federal extended benefit claims based upon the Controlling UI Claim*. The TRA basic claim is not reduced by any state extended benefits or training extensions.
- TRA benefits are NOT payable during breaks in training that are 31 days or more. The 52 continuous calendar week period for a TRA additional claim begins with the effective date of the claim and ends 52 continuous weeks later. Any break in training is counted towards the 52 continuous calendar week period.
- In order to receive additional TRA benefits, a bona fide application for training must be received within 210 days after the date of the first certification under which the individual is covered, OR, if later, within 210 days after the date of the individual’s most recent partial or total separation.
- Payments of TRA for additional weeks may be made only during those 52 weeks in which the worker is actually participating fully in TAA-approved training; and, the participation in training requirement may not be waived under any circumstances.
Training, Job Search, Relocation
As an adversely affected worker, you may qualify for other kinds of Trade Adjustment Assistance whether or not you are receiving TRA weekly benefits. If your job prospects are poor in your usual occupation, you may apply for:
- TRAINING: California UI law now provides that if a request for training is TAA-approved, you may receive any UI benefits to which you are entitled and availability and seek-work requirements are waived while you attend training. Also, you may receive training-related costs that include tuition, books, materials, and, in some cases, travel and subsistence allowances.
- JOB SEARCH AND RELOCATION: If you have no reasonable expectation of obtaining suitable work within your commuting area, you may be able to receive financial assistance to seek work elsewhere. If you obtain work in another area, you may apply for relocation allowances to assist in moving family and household goods to the new location. APPLICATIONS MUST BE MADE IN ADVANCE of a job search or relocation in order to receive approval for payment.
