CTB Streamline Rights and Responsibilities

Unemployment Insurance (UI) Recipient’s Rights and Responsibilities for the TAA Training Enrollment Verification (DE 3422TAA) for the CTB Program

Although your training has been authorized by an Employment Development Department (EDD) Trade Adjustment Assistance (TAA) Specialist under the federal Trade Act, eligibility to receive regular Unemployment Insurance (UI) benefits while you attend training must be determined separately by a representative of the EDD UIProgram. As required by California Code of Regulations (CCR), Title 22, Section ‎1326-6, school or training attendance must be reported to the EDD in the week school or training begins while receiving UI benefits. School or training attendance may affect your eligibility for continued  UI  payments unless you are determined eligible for the California Training Benefits (CTB) program by the  UI  Program.

Your TAA authorized training is approvable for the CTB program as long as you meet all other UI eligibility criteria. As an eligible  CTB  program participant, you will be exempt from UI work search and availability requirements during the period of approved training and UI payments will continue as long as you meet all other UI eligibility criteria. Weekly Trade Readjustment Assistance (TRA) benefits will begin once regular UI and any training or federal extension benefits end, as long as you are still attending the training as allowed in your TAA training agreement and you are approved for CTB.
The  UI  Program can expedite your approval for the  CTB  program through the  CTB  streamline process and prevent delays in your  UI  benefits once you start attending training. To participate in the  CTB  streamline process, you must authorize your  TAA  specialist to complete and submit your training information on the TAA  training enrollment verification for  CTB  streamline (DE 3422TAA) form directly to the  UI  program. You will be asked to sign the TAA  training enrollment verification for  CTB  streamline authorization to give your  TAA  specialist permission to release your training information directly to the  UI  Program. This will allow the  UI  Program to determine your  CTB  eligibility without contacting you or your training facility to obtain the information.  UI  benefits can not be paid when you submit your Continued Claim form (DE 4581) for the week you start training until you are determined eligible for  CTB  by the  UI  program.
Before you sign the  TAA  Training Enrollment Verification for  CTB  streamline form, you must know your UI rights and responsibilities by reading this entire document and the CTB Fact Sheet (DE 8714U). (After reading, keep these documents for your records.) Signing the TAA Training Enrollment Verification does not guarantee your entitlement or eligibility for CTB or continued UI payments unless you meet all the legal UI pre-conditions listed below and you continue to meet all UI eligibility criteria.

Legal Pre-Conditions for CTB Eligibility

Once you start attending  TAA  authorized training and the completed and signed  TAA  Training Enrollment Verification for  CTB  streamline form is received by the  UI  Program at the Special Claims Office, your  UI  claim will be reviewed and your request for  CTB  approval will be processed. If all of the following legal  UI  pre-conditions are met, you will be approved for  CTB  and you should expect your  UI  payments to continue:
  • You have a valid and potentially payable UI claim on file with the EDD.
  • You are currently receiving UI payments and there are no existing disqualifications or other potential eligibility issues preventing continued UI payments on your claim.
  • You are currently attending the school or training as indicated by your TAA Specialist and you have reported this information on your Continued Claim form for the week you begin training.

CTB Eligibility

After you begin training and the UI Special Claims Office determines you are eligible for the CTB program, you will be mailed a Notice of Determination (DE 1080) by the EDD within ten working days from the date the TAA Training Enrollment Verification for CTB streamline is received and processed by the UI Special Claims Office.

After that, any pending  UI  payments will be issued if you are otherwise eligible to receive the payments. You can access recorded information, which is updated daily, about your most recent  UI  payment by calling the  EDD  at ‎‎1-866-333-4606, 24 hours per day, 7 days a week.
Once you receive the Notice of Determination you are responsible for reviewing the training information on the notice to make sure it agrees with the training agreement. Your potential eligibility for a training extension (TE) claim is also included in the Notice of Determination. Refer to the  CTB  Fact Sheet for an explanation of  TE  claims.
Be sure to read the entire Notice of Determination and follow the Rights and Responsibilities section on the notice for ongoing  CTB/TE  eligibility requirements. Your Training Specialist will also give you a copy of the Training Provider Letter (DE 3100CTB) for you to give to your training facility, which provides an explanation about biweekly certifications required on the back of each Continued Claim form during your period of approved  TAA  training. If you have questions about the Notice of Determination or need to make corrections, you will need to contact the  UI  Special Claims Office at ‎1-888-697-1760.
If you need to attend training for a longer period of time than approved on in your  TAA  training agreement and on the Notice of Determination, you must notify your  TAA  Specialist before you start attending any unapproved period of training. Your  TAA  Specialist will, in turn, notify the  UI  Special Claims Office that the actual training date goes beyond the original training agreement date. If you fail to notify your  TAA  Specialist before starting an unapproved period of training, the approval of the additional period of training may be denied and your  UI  benefits may stop.

Eligibility Exceptions

You may not be eligible for the  CTB  program if you do not meet all the  CTB  legal  UI  pre-conditions, there are other potential eligibility issues, or you are currently under a disqualification. If questions about your eligibility need to be resolved before  CTB  can be approved, you will be contacted for additional information. In that case, no  UI  payments can be made until you are offered the opportunity to provide needed information and you are found eligible.

If for some reason the  UI  Program can not complete your  CTB  approval after the  EDD  receives your  TAA  Training Enrollment Verification for  CTB  streamline, a form will be mailed to you with instructions on what you need to do or you will be contacted for additional information. Examples of reasons why  CTB  eligibility can not be completed include:

  • You were previously denied UI payments.
  • The UI Program must resolve other eligibility issues.
In the event you are not eligible to receive  UI  benefits (including denial of  CTB ), you will be mailed a Notice of Determination indicating the reason. You have the right to file an appeal with the  EDD  if you disagree with the information on the notice.
