NOTICE OF DENIAL OF TRAINING EXTENSION BENEFITS UNDER THE CALIFORNIA TRAINING BENEFIT PROGRAM

The following information explains any deductible benefit amounts displayed in Items A through E on the front of this notice. These amounts were used to calculate your eligibility to receive TE benefits on either a new or existing TE claim. If the combined amounts of Items A through E equals or exceeds the maximum amount of TE benefits available to you, you are not eligible to file a new TE or to continue to receive benefits on an existing TE, whether or not you are still attending CTB approved training.

Item A displays the Maximum Benefit Amount (MBA) of your most recent regular UI claim in existence when you were approved for CTB. The deductible MBA includes the entire claim award whether or not you received all the benefits from that claim. (CUIC Section 1271[b] and CUIC Section 1271[c])

Item B displays the actual deductible amount of any previously paid training extension benefits that have been paid to you during the time you have attended CTB approved training and prior to the date this notice was issued. (CUIC Section 1271[b])

Items C and D display the deductible amount of Federal and/or Federal-State (FED-ED) extended benefits paid prior to the date this notice was issued. The deductible amounts are calculated based on the following:

  • Item C. If extensions are attached to the same parent UI claim on which you were approved for CTB, then the deductible amount includes the total of all extension claim benefits paid to you. (CUIC Section 1271[d][3], 26 USC 3304 Notes Section 4001[e], and 20 CFR 615.9[b])
  • Item D. If extensions are not attached to the same parent UI claim on which you were approved for CTB, then the deductible amount includes the total of all extension claim benefits for weeks paid after the CTB training was approved. (CUIC Section 1271[d][3], 26 USC 3304 Notes Section 4001[e], and 20 CFR 615.9[b])

Item E displays the MBA of any subsequent valid new regular UI claim filed during the time you have attended CTB approved training. The deductible MBA includes the entire claim award whether or not you received all the benefits from that claim. (CUIC Section 1271[b] and CUIC Section 1271[d][2])

This decision is final unless appealed to an Administrative Law Judge of the California Unemployment Insurance Appeals Board within thirty days from the date this notice was mailed to you. You may appeal this notice by completing the enclosed appeal form, or by writing a letter. In your appeal you must state the reasons why you do not agree with this decision. Appeals should be sent to the office on this notice. While an appeal is pending you must continue to certify for benefits and submit weekly continued claim forms for each week that you contend you are eligible (applies only if you have an active TE claim on file). If the final decision by the California Unemployment Insurance Appeals Board finds you eligible, you can be paid only for those weeks you certified for benefits and met all other eligibility requirements. If you were not provided with weekly continued claim forms, you will be provided with forms once EDD received the appeal decision.
