Notice of Amended FED-ED Benefits

The Federal-State Extended Duration Benefits (FED-ED) extension on your regular unemployment claim dated mm/dd/yyy has been amended.
The FED-ED extension temporarily provided up to 20 additional weeks of benefits during a period of high unemployment. California’s unemployment rate is no longer at the level established by the federal government in order for the state to qualify for the up to 20 additional weeks so the Employment Development Department (EDD) is mandated under law to recalculate your benefits.
All claims with effective dates of May 10, 2020, through August 1, 2021, that have not exhausted their benefits, may have their maximum benefit awards reduced to under 20 weeks.
Your weekly benefit amount will remain the same, but because the number of weeks has been reduced, the maximum benefit amount of your FED-ED extension has also been reduced.
Claimants who have received 13 or more weeks’ worth of FED-ED benefits will no longer be eligible for FED-ED on their existing claim after the benefit week of August 7, 2021.

Additional FED-ED Eligibility Requirements

Beginning July 25, most Pandemic Unemployment Assistance (PUA) and FED-ED claimants are expected to look for suitable work to meet eligibility requirements for unemployment benefits. If you are required to look for work, we will mail you a notice explaining your work search requirement.
In order to receive FED-ED benefits, you must continue to meet all Unemployment Insurance (UI) eligibility requirements. You must also meet the following FED-ED benefit eligibility requirements:
  1. You must accept offers of suitable work. Your FED-ED benefits may be denied if you fail to accept offers of suitable work or fail to apply for suitable work when referred by California’s Workforce Services (CUIC Section§ 4553). If you do not have a date to return to work within 30 days of filing your FED-ED extension, your prospects for obtaining work in your usual occupation are not considered to be good. Therefore, any work that you are capable of performing is considered suitable work.
    If you are disqualified on your FED-ED extension under the job refusal provisions in CUIC Section§ 4553, you will be ineligible to receive FED-ED benefits for the week you refused work and will remain ineligible until you have:
    1. Performed work in at least four separate weeks after the week your disqualification began, and
    2. Earned at least four times your weekly benefit amount. (CUIC Section§ 4555[a][b])
  2. If you were previously disqualified on your regular claim or other federal extensions claim for refusing work under CUIC Section§ 1257[b], the disqualification will be reinstated on your FED-ED extension until you have:
    1. Satisfied the ‎2–10 week period of disqualification (as required by CUIC Section§ 1260[b]), and
    2. Performed at least one week of full-time work after the week your disqualification began, or
    3. Earned at least the same amount as your weekly benefit amount. (CUIC Section§ 4552 [d])
  3. If you were previously disqualified on your regular unemployment claim or other federal extension claim, or were separated from your job due to the irresistible compulsion to consume intoxicants under CUIC Section§ 1256.4, the disqualification will be reinstated on your FED-ED extension until you have:
    1. Performed work after the week your disqualification began, and
    2. Earned at least five times your weekly benefit amount. (CUIC Section§ 4552[f])

Appeal Rights

This decision is final unless appealed to an Administrative Law Judge (ALJ) of the California Unemployment Insurance Appeals Board (CUIAB) within 30 days of the mail date on this notice. In your appeal, you must state the reasons why you disagree with this decision. Appeals should be sent to the EDD office at the top of this notice. While an appeal is pending, you must continue to certify for benefits for each week you believe you are eligible. If the final decision by the California Unemployment Insurance Appeals Board (CUIAB) finds you eligible, you can only be paid for those weeks you certified for and met all other eligibility requirements.

Fraud Notice

Under 18 U.S.C. Section§ 1001, knowingly and willfully concealing a material fact by any trick, scheme, or device or knowingly making a false statement in connection with this claim is a federal offense, punishable by a fine up to $10,000 or imprisonment up to five years, or both.
